BT and TalkTalk to challenge DEA this week
The judicial review of the legislation will take place on Wednesday.
The internet service providers are set to challenge the legislation on Wednesday (March 23rd 2011), having argued that it was rushed through parliament in the run-up to the general election.
Andrew Heaney, executive director of strategy and regulation at TalkTalk, explained the broadband company submitted its application for a review of the DEA on the grounds that it is illegal and disproportionate.
The act was created in a bid to enforce copyrights by clamping down on illegal filesharing. Under the DEA, film and music firms will be able to write to people suspected of the practice to warn them they are breaking the law.
But Mr Heaney has argued the measures will not work, will be hugely expensive and are "grossly unfair".
He added: "We are not against trying to reduce illegal filesharing, but it must be done in a fair and legal way that properly respects consumers' interests."
